US Intellectual Property Trends: Cell and Gene Therapy Products
Intellectual property issues surrounding emerging cell and gene therapies have increasingly become a hot topic.
During this presentation, I will first provide a high-level overview of the FDA approved cellular and gene therapy products in the US (16 as of March 2018). Second, I will review some of the latest US case law developments regarding patents covering cell and gene therapy products. Next, I will provide an overview of US case law regarding what subject matter should be eligible for patent protection, i.e., Section 101, in the life science industry. Finally, I will summarize the latest trends and responses from the United States Patent and Trademark Office (USPTO) in regards to applicant’s seeking protection for subject matter related to cell and gene therapies, e.g., stem cells.
